By accessing or using PassHHA ("the Service") at passhha.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service. These Terms constitute a legally binding agreement between you and Code Kubic Solutions (Company No. 2663998-P), a company registered in Malaysia, operating under the trade name PassHHA. Your continued use of the Service after any changes to these Terms constitutes acceptance of those changes.

You must be at least 13 years of age to use PassHHA. By using the Service, you represent and warrant that you meet this requirement. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf. You may not use the Service if you are prohibited from doing so under applicable law.

PassHHA provides HHA (Home Health Aide) exam preparation materials, including practice questions, mock exams, readiness scores, study guides, and related educational content. The Service is intended solely for personal, non-commercial exam preparation. PassHHA is an educational platform and is not affiliated with, endorsed by, or certified by any state licensing board, testing provider (including Prometric), or healthcare regulatory authority. Completion of our program does not guarantee passage of any state or national HHA certification exam.

To access certain features, you must create an account by providing a valid email address and password. You agree to: • Provide accurate, current, and complete information during registration • Maintain and promptly update your account information • Keep your password secure and confidential • Notify us immediately of any unauthorized use of your account at help@passhha.com • Accept responsibility for all activities that occur under your account One account per person. You may not create multiple accounts to circumvent access restrictions or the Pass Guarantee requirements.

Free Access: PassHHA offers free access to a limited number of daily practice questions and features at no charge. Full Access Plan: Our Full Access plan is available for a one-time payment of $9.99 (USD), which grants access to all premium features for 99 days from the date of purchase. This is a one-time charge, not a recurring subscription. There are no automatic renewals. Pricing: We reserve the right to change our pricing at any time. Price changes will not affect purchases already made. Payment Processing: All payments are processed by Stripe, Inc. By completing a purchase, you agree to Stripe's terms of service and authorize the charge to your payment method. Taxes: Prices displayed do not include applicable taxes. Any applicable sales tax, VAT, or similar charges will be calculated and added at checkout where required by law.

General Refund Policy: All sales are final except as described in our Pass Guarantee below. We do not offer refunds for change of mind, partial use of the service, or failure to use the service during the access period. Pass Guarantee: If you purchase Full Access, complete at least 3 full mock exams within your 99-day access period, achieve a Readiness Score of 70% or higher on your final mock exam, and subsequently fail your official HHA written certification exam, you may request a full refund of your purchase price. To claim the Pass Guarantee refund, you must submit a written request to support@passhha.com within 30 days of your failed exam, along with documentation of your failed exam result (score report or official notification from the testing provider). The Pass Guarantee applies only to the written (knowledge) portion of the HHA certification exam, not the skills demonstration. Only one refund per customer. Refunds are issued to the original payment method within 5–10 business days of approval. All content on PassHHA — including but not limited to practice questions, explanations, mock exams, study guides, readiness scoring methodology, graphics, logos, and software — is owned by or licensed to PassHHA and is protected by United States and international copyright, trademark, and intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own personal, non-commercial exam preparation purposes only. You may not: • Copy, reproduce, distribute, or publicly display any content from PassHHA • Scrape, crawl, or systematically download content from the Service • Create derivative works based on our content • Sell, sublicense, or commercially exploit any portion of the Service • Use any content from PassHHA in other training materials, apps, or websites Any unauthorized use of our content may result in termination of your account and legal action.

You agree not to: • Share your account credentials with any other person • Use the Service for any unlawful purpose or in violation of any applicable law • Attempt to gain unauthorized access to any part of the Service or its infrastructure • Interfere with or disrupt the integrity or performance of the Service • Upload or transmit viruses, malware, or any other malicious code • Engage in any automated use of the Service, including bots, scrapers, or data miners • Impersonate any person or entity or misrepresent your affiliation • Harass, threaten, or harm other users or PassHHA staff • Attempt to reverse-engineer, decompile, or disassemble any software component of the Service

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (B) THE RESULTS OBTAINED FROM USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE; (C) THE QUALITY OF ANY CONTENT OBTAINED THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS; OR (D) ANY ERRORS IN THE SERVICE WILL BE CORRECTED. PASSHHA DOES NOT GUARANTEE THAT USE OF THE SERVICE WILL RESULT IN PASSING ANY CERTIFICATION EXAM. EXAM CONTENT AND REQUIREMENTS ARE CONTROLLED BY STATE LICENSING BOARDS AND TESTING PROVIDERS, NOT BY PASSHHA.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PASSHHA AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, SERVICE INTERRUPTION, OR THE COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY. IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO PASSHHA IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $25.00 USD. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OF LIABILITY FOR CERTAIN TYPES OF DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

You agree to indemnify, defend, and hold harmless PassHHA and its owners, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: • Your access to or use of the Service • Your violation of these Terms • Your violation of any third-party right, including intellectual property or privacy rights • Any content you submit or transmit through the Service

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause and with or without notice, including for: • Violation of these Terms • Fraudulent or abusive behavior • Chargebacks or payment disputes initiated in bad faith • Any conduct we determine to be harmful to other users or to PassHHA Upon termination, your right to use the Service immediately ceases. Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, warranty disclaimers, indemnification, and limitations of liability. You may terminate your account at any time by contacting us at help@passhha.com. Termination does not entitle you to a refund except as provided under the Pass Guarantee.

These Terms are governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions. The parties submit to the exclusive jurisdiction of the courts of Malaysia for the resolution of any disputes arising from or relating to these Terms or the Service. As a user accessing the Service from the United States or any other country, you acknowledge that: (a) PassHHA is operated from Malaysia; (b) Malaysian law governs this agreement; and (c) any legal proceedings must be brought in Malaysian courts. Nothing in this section limits our right to seek injunctive or other equitable relief in any jurisdiction to protect our intellectual property rights.

Before filing any formal legal action, you agree to contact us at support@passhha.com and provide a written description of your dispute. We will attempt to resolve the dispute informally within 30 days of receiving your written notice. If we cannot resolve the dispute informally, either party may refer the dispute to the Asian International Arbitration Centre (AIAC) in Kuala Lumpur, Malaysia, under its rules then in effect. The arbitration shall be conducted in English. The arbitrator's decision shall be final and binding on both parties. Given the low cost of our service ($9.99), we strongly encourage users to resolve disputes through our informal process first — it is almost always faster and less expensive than formal proceedings for all parties.

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page. For significant changes, we will notify registered users by email at least 14 days before the changes take effect. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service before they take effect.

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and PassHHA regarding your use of the Service and supersede all prior agreements, understandings, and representations. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights.
